Welcome to Taleway ("we," "us," or "our"). By accessing or using our website (taleway.xyz) or our mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

1. The Service

Taleway is an ambient audio application that uses your location to generate and narrate stories about your surroundings. The App utilizes Artificial Intelligence (AI) and third-party text-to-speech services to create this content in real-time.

2. Critical Safety Warnings

Your safety is your responsibility.

Distracted Driving: If you use Taleway while driving, operating heavy machinery, or riding a bicycle, you do so at your own risk. You agree to obey all traffic laws and regulations. The App is designed to be "eyes-free" audio; do not interact with the screen while your vehicle is in motion.

Situational Awareness: If using the App while walking or exploring, stay aware of your surroundings. Do not enter private property, dangerous areas, or closed locations based on the App's narration. We are not liable for any physical injury, accidents, or property damage that occurs while you are using the App.

3. AI Disclaimers (Accuracy & Content)

The stories and facts presented in Taleway are generated by Large Language Models (AI).

No Guarantee of Accuracy: AI can "hallucinate" or invent facts. We do not guarantee that the historical, geographical, or cultural information provided in the stories is 100% accurate. Taleway should be used for entertainment purposes, not as a definitive educational or navigational resource.

Content Variance: While we implement safety filters, AI may occasionally generate content that is unexpected. You acknowledge that the unpredictability of AI-generated content is a feature of the Service.

4. User Conduct & Restrictions

You agree not to:

• Use the App for any illegal purpose.
• Attempt to reverse engineer, decompile, or extract the source code or underlying AI prompts of the App.
• Scrape, record, or redistribute the audio content generated by the App for commercial purposes.
• Interfere with the App's operation or overwhelm our servers (e.g., DDOS attacks).
• Spoof your location data to generate content for locations you are not physically present in (unless using a specific "remote" feature provided by the App).

5. Intellectual Property

Our IP: The App, its design, code, branding, and the unique combination of AI prompts and audio synthesis are the property of Taleway and are protected by copyright and intellectual property laws.

Generated Content: The audio stories you hear are licensed to you for personal, non-commercial use only. You do not own the recordings.

6. Privacy

Your use of the App is also governed by our Privacy Policy, which explains how we collect and use your location data.

7. Third-Party Services

The App relies on third-party services (including OpenAI/Anthropic for text and ElevenLabs for audio). We are not responsible for service interruptions, outages, or changes in service from these third-party providers that may affect Taleway's availability.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TALEWAY AND ITS OWNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

10. Termination

We reserve the right to suspend or terminate your access to the App at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Virginia, without regard to its conflict of law provisions.
